Beijing: Auntie lost her life when she went out for a walk with her dog. Who is to blame?

At 11:30 p.m. on March 12, 2021, Aunt Zhao from Shunyi, Beijing, led her pastoral dog out for a walk. But not long after he went out, a border collie without a leash suddenly appeared from the side, and Bian Mu circled around Aunt Zhao.

Aunt Zhao was very frightened, and the owner of Bian Mu quickly ran over to drive Bian Mu. Just after driving Bian Mu to the side, before the two of them could breathe a sigh of relief, Bian Mu rushed towards Aunt Zhao again, knocking Aunt Zhao to the ground at once. All of a sudden, after Aunt Zhao fell to the ground, she felt unwell and was sent to the hospital, and passed away that night.

Aunt Zhao's wife, Mr. Jiao, believes that the border shepherd's owner, Xiao Zhang, did not leash the dog when he walked the dog, and the dog ran around at will, causing the tragedy of his wife's death, and Xiao Zhang must be responsible for this. In May 2021, Mr. Jiao sued Xiao Zhang to the Shunyi Court, asking Xiao Zhang to pay 680,418 yuan in compensation for death, 59,460 yuan for funeral expenses, and 100,000 yuan for mental damage, totaling 839,878 yuan.

Recently, the court heard the case. Bian Mu's owner Xiao Zhang said, "If she fell, I must have some responsibility. But if she dies, I will not take responsibility. I don't think a normal person will die after a fall, for sure. It's its own disease, otherwise who would die suddenly."

During the trial, the judge inquired about the handling of the dog license for the plaintiff and the defendant. The plaintiff, Mr. Jiao, had a dog license, while the defendant, Xiao Zhang, did not have a dog license, nor did he report it to the neighborhood committee.

The defendant's lawyer believed that Aunt Zhao went out to walk the dog at close to 12 in the morning, and it was very risky to take the dog out alone, and she should be accompanied by her family. The plaintiff's lawyer blamed the illegal act on the victim. Is it the victim's fault that he went out in the middle of the night and was robbed? This is the logic of the robber.

Currently, the case is still under trial. However, it is the most basic to get a dog certificate in the city and go out on a leash. If these can't be done, then don't keep dogs, especially large dogs, which are a great threat to everyone's safety.
